A. Requirements To Join

1. THE COLLECTION SHOP Affiliate Program is open to anyone with a website and valid email address on the Internet.
2. Exceptions to the above are websites which promote or contain sexually explicit material, violence, illegal activities such as software piracy, or discrimination based on race, sex, religion, national origin, physical disability, sexual orientation or age.
3. There is no charge to become an Affiliate.
4. Affiliates MUST read this Agreement carefully before signing up.
5. THE COLLECTION SHOP'S banner MUST be prominently displayed on the affiliate's website at all times which will link to The Collection Shop website at www.thecollectionshop.com.
6. This Agreement is totally Non-Exclusive and does not impede the freedom of your website content and/or operations in any way.

1. 8% commission paid to YOU on The Collection Shop items purchased through YOUR links
2. Be a part of one of the fastest growing SECONDARY MARKET DEALERS on the web.
3. Provide your customers the most complete inventory of Limited Edition art AND cOLLECTIBLES on the web.
4. If you can't find an item for your client then we will do the research for you.
   

C. Enrollment in the Program

1. To begin the process, the affiliate must complete the Affiliate Program Application. THE COLLECTION SHOP will evaluate the application in good faith and will notify the affiliate of their acceptance or rejection. THE COLLECTION SHOP may reject an affiliate's application if it is determined (in THE COLLECTION SHOP's sole discretion) that the site is unsuitable for the Affiliate Program. Unsuitable sites are outlined in item 2 of the Requirements to Join section of the Affiliate Agreement.
2. If your application is accepted, we will assign you a "Program Identify Number" which will be used to track all commissions earned for referred retired sales.

D. Commission Structure & Payment

1. All products sold by THE COLLECTION SHOP to customers originating from
   the Affiliate's website, or referral URL, qualify to earn Affiliate referral fees as described below.
2. THE COLLECTION SHOP reserves the right to reject any order that does not comply with THE COLLECTION SHOP policy.
3. Every customer who purchases products from THE COLLECTION SHOP is deemed to be a customer of THE COLLECTION SHOP.
4. Affiliates do not have the authority to make or accept any offer on behalf of THE COLLECTION SHOP.
5. THE COLLECTION SHOP will always determine the price of THE COLLECTION SHOP products.
6. Affiliates are paid an 8% commission on items sold through your referral links.
7. Transactions from the Buy/Sell section and Weekly Specials do not qualify for the affiliate program.
8. Commissions are paid in U.S. dollars on or around the last day of each month for the earnings of the prior month. All checks will be paid to the name of the affiliate company. (with the exception of Pre-Orders, which will be paid after product has shipped)
9. There is no minimum amount restriction. All commissions are paid.
10. No minimum amount of sales are required to remain active.
11. Commissions on credit card charge backs and refunds will be deducted
    from your next monthly commission payout.
12. THE COLLECTION SHOP reserves the right to change the commission percentage if and when necessary. Affiliates will be informed 7 days prior to any changes.

E. Causes For Termination

1. In the unlikely event that it becomes necessary to terminate our partnership, we'll do so only after careful consideration of the facts. We understand that you will be building a business to generate income over the long term. Therefore we would only terminate an affiliate who has explicitly broken the policy as described in this agreement.
2. Affiliates will be terminated if they are found to be promoting or linking to THE COLLECTION SHOP from websites which promote or contain sexually explicit material, violence, illegal activities such as software piracy, or discrimination based on race, sex, religion, national origin, physical disability, sexual orientation or age.
3. Any affiliate using unfair electronic means to generate bogus traffic, referrals and sales for the purpose of inflating commissions will be terminated.
4. An affiliate who ignores warnings to cease and desist any activities we deem negligent, inappropriate, or harmful to THE COLLECTION SHOP and or other affiliates, will be terminated.
   
5. Affiliates who are terminated will be notified via email. Any affiliate terminated for the above reasons will not receive any commissions due.
6. Affiliates will be terminated if they are found to have removed THE COLLECTION SHOP'S banner from their website.

F. Resolution Of Disputes

1. In the event of disagreement, let's resolve it swiftly and amiably. Life is too short to dally over petty issues. Most differences can patched up easily enough if the lines of communication are open.

G. Copyright & Intellectual Property

1. Title, ownership, and intellectual property rights shall remain with THE COLLECTION SHOP and vigorously protected by all copyright laws and treaties.
2. This agreement gives you no rights to any content on the THE COLLECTION SHOP website.
3. THE COLLECTION SHOP claims no right to ownership of any of your website content
4. THE COLLECTION SHOP is not responsible for Affiliate's misuse of any copyrighted material.

H. Limits To Liability

1. THE COLLECTION SHOP shall have no liability for any indirect, incidental or
   consequential damages, or any loss of revenue arising under or with respect to this agreement or the THE COLLECTION SHOP Affiliate Program, even if THE COLLECTION SHOP has been advised of the possibility of such damages.
2. The aggregate liability arising with respect to this Agreement shall in no event exceed the total membership fee paid by the Affiliate or Member.
   

I. Privacy Policy

1. We respect the privacy of our Affiliates. Your contact information, affiliate stats, reports and commission amounts are only available to two parties. Yourself and The Collection Shop staff.

J. General

1. As an Affiliate your are an independent contractor, and nothing in this Agreement shall create any form of partnership, joint venture, franchise, agency, or employment relationship between the parties.
2. You will not be treated as an employee with respect to the Internal Revenue Code, Social Security Act, Federal Unemployment Acts, or any other federal, state, or local statute, ordinance, rule, or regulation of any country whatsoever.
3. You shall not assign this Agreement, by operation of law or otherwise, without the prior express written consent of THE COLLECTION SHOP.
   
4. Subject to the foregoing, this Agreement is binding upon, insures to the benefit of, and is enforceable by the parties and their respective successors and assigns.
5. This agreement will stay in effect as along as THE COLLECTION SHOP makes
   this service available, unless this agreement is terminated beforehand due to breach of its terms.
6. You and THE COLLECTION SHOP have the right to terminate this agreement at any time in writing. You agree that payment will be withheld until correct
   amount due is determined.
7. We will make every effort to ensure that our website and tracking
   system is operational at all times. In the event of unavoidable technical difficulties which may cause service and tracking interruptions, you
   agree that THE COLLECTION SHOP is not liable in any way for such interruptions.
8. THE COLLECTION SHOP reserves the right to make changes to this affiliate agreement as and when necessary. Affiliates will be notified 7 days in advance via email.

Banners come in various sizes 468 x 60, 123 x 123, and 234 x 60. If you need a specific size for your website please let us know and we will try our best to accommodate your request.
